F.V. v. Barron Transgender Name Change on Birth Certificates

Idaho’s liberal and transgender community celebrated a victory out of the federal courthouse in 2018 after Attorney General Wasden conceded all liability.

Up until this case, transgender individuals were not able to change their sex on their birth certificates in Idaho to match the ‘gender they identify with’ until Idaho’s Attorney General not only lost but conceded the case.

This decision now puts Idaho among 46 other states, all of which allow transgender people to change their birth certificates to reflect their gender.

FV vs Baron, which is a case that made national news, involved Dani Martin, a transgender and a plaintiff in F.V. v. Barron.  Martin filed a complaint against Idaho’s Department of Health and Welfare under F.V. v. Barron last spring.

“It feels great knowing that the gender markers can be changed and for my safety,” says Dani Martin, a transgender woman and a plaintiff in F.V. v. Barron.

A federal judge ruled in favor of Martin after announcing that the state’s Attorney General conceded all liability. Attorney General Wasden paid out Lambda legal, which was the far left law firm representing Martin.

“In this particular case the state actually admitted that they had no rational basis for that rule,” says Cockerille.
